Terms of Service

These Terms of Service govern your access to and use of TrustedPerch websites, applications, marketplace features, host tools, messaging, document workflows, verification features, and related services. “TrustedPerch,” “we,” “us,” and “our” refer to TrustedPerch, LLC. By creating an account, accepting these Terms, or using the services, you agree to these Terms and our Privacy Policy.

TrustedPerch is currently offered as a beta service. Features may change, be incomplete, or be unavailable from time to time.

You must be at least 18 years old and legally able to enter contracts. You must provide accurate information, keep your contact details current, protect access to your email and account, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account.

TrustedPerch provides technology that helps housing providers create and manage mid-term rental listings and helps renters discover, evaluate, and communicate about housing. Optional tools may include calendars, messaging, documents, identity or property verification, payment connectivity, background-check requests, and related workflows.

TrustedPerch is not a landlord, tenant, property manager, real-estate broker, travel agency, employer, staffing agency, or party to any rental agreement unless a separate written agreement expressly states otherwise. Hosts and renters contract directly with each other and remain responsible for applicable housing, licensing, tax, accessibility, fair-housing, consumer-protection, and other laws.

Hosts are responsible for the accuracy, legality, availability, condition, pricing, rules, photos, and disclosures associated with their properties. Renters are responsible for evaluating listings, asking questions, reviewing agreements, and determining whether housing meets their needs. Users must communicate honestly and may not misrepresent identity, ownership, professional status, availability, pricing, or material facts.

TrustedPerch may review, reject, suspend, unpublish, or remove content or accounts that appear inaccurate, unsafe, unlawful, misleading, discriminatory, fraudulent, or inconsistent with these Terms. We are not required to monitor every listing or communication.

Verification labels, checks, badges, document reviews, public-record comparisons, identity checks, background-check availability, or similar signals are limited screening tools. They are not guarantees of identity, ownership, safety, suitability, creditworthiness, professional status, legal compliance, property condition, or future conduct. Information may be incomplete, delayed, outdated, or supplied by third parties.

You must use your own judgment and conduct any additional diligence appropriate to your situation. TrustedPerch does not guarantee that a listing, host, renter, stay, payment, agreement, or verification result is accurate or risk-free.

TrustedPerch does not hold rent, security deposits, escrow funds, or other transaction funds. Payments may be made directly between users or processed by independent payment providers. A payment provider may create connected accounts, collect payment information, transfer funds, charge processing fees, apply reserves, or impose its own terms.

Unless expressly stated in a separate written agreement, TrustedPerch is not the merchant of record for rent, does not guarantee payment, does not insure funds, and is not responsible for chargebacks, reversals, bank delays, payment-provider decisions, tax reporting, or disputes between hosts and renters.

TrustedPerch is not an insurer, insurance producer, law firm, attorney, financial institution, escrow company, credit-repair organization, or professional advisor. Information, templates, checklists, generated documents, resource articles, and suggested workflows are provided for convenience and general informational purposes only. They are not legal, tax, insurance, financial, medical, or other professional advice.

Document templates may not be appropriate for every property, jurisdiction, or transaction. Users should consult qualified professionals before relying on a lease, disclosure, background-check process, deposit arrangement, insurance product, or legal requirement.

Some features require a paid membership, add-on, transaction fee, verification fee, or third-party fee. Prices, included units, quotas, promotional periods, trials, and feature availability will be shown before purchase. Recurring subscriptions continue until canceled as described at checkout. Taxes and third-party processing fees may apply.

Beta, promotional, or free access may be changed or discontinued. Unless required by law or expressly stated otherwise, fees already paid are nonrefundable once the applicable service period or third-party service has begun.

Optional identity, credential, property, or background checks may be provided by independent vendors. Additional notices, authorizations, and vendor terms may apply. Users requesting or using reports must comply with all applicable laws, including restrictions on permissible purpose, consent, adverse action, housing decisions, and discrimination. TrustedPerch does not make rental decisions for hosts.

You may not use TrustedPerch to violate law; discriminate unlawfully; harass or threaten others; facilitate fraud; evade sanctions; scrape or harvest data; upload malware; probe security; impersonate another person; interfere with the service; send spam; publish unlawful, deceptive, or infringing content; bypass safeguards; or use personal information for an unrelated purpose.

You retain ownership of content you submit. You grant TrustedPerch a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, distribute, and otherwise use that content as reasonably necessary to operate, secure, improve, and promote the services and your listings. You represent that you have the rights and permissions needed to submit the content.

The TrustedPerch service, branding, software, design, and non-user content are owned by TrustedPerch or its licensors and are protected by applicable intellectual-property laws.

The service may link to or integrate with payment processors, identity providers, analytics providers, cloud hosting, storage, mapping, electronic-signature, background-check, calendar, insurance, deposit-protection, or communications services. Third parties operate under their own terms and privacy practices. TrustedPerch is not responsible for third-party services, outages, decisions, content, or security.

You may stop using the service at any time. We may restrict, suspend, or terminate access when reasonably necessary to protect users, comply with law, investigate suspected misconduct, address nonpayment, enforce these Terms, or operate the beta safely. Sections that by their nature should survive termination will survive.

To the fullest extent permitted by law, the services are provided “as is” and “as available.” TrustedPerch disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, and quiet enjoyment. We do not warrant uninterrupted operation, successful matches, completed transactions, legal compliance by users, or any particular result.

To the fullest extent permitted by law, TrustedPerch and its officers, members, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, data, goodwill, housing opportunities, or business; personal disputes; property loss; bodily injury caused by another user; or losses arising from third-party services.

To the fullest extent permitted by law, TrustedPerch’s aggregate liability arising from the services will not exceed the greater of the amount you paid TrustedPerch during the twelve months before the event giving rise to the claim or one hundred U.S. dollars. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless TrustedPerch and its affiliates from claims, damages, losses, liabilities, and reasonable costs arising from your listings, property, stay, agreements, payments, content, legal violations, misuse of the service, or breach of these Terms.

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except where applicable consumer law requires otherwise. Before filing a claim, you agree to contact us and make a good-faith effort to resolve the dispute informally. Subject to mandatory law, disputes will be brought in state or federal courts with jurisdiction over TrustedPerch, LLC.

We may update these Terms as the beta and services evolve. We will post the revised version and update the effective date. When required, we will provide additional notice or request renewed acceptance. Continued use after an update becomes effective means you accept the revised Terms.
